Renovation works in common areas are often a source of conflict in homeowners associations. Not all works require the same voting majority, and misinterpreting the legal requirements may lead to challenges or nullification of resolutions.
The Ley de Propiedad Horizontal differentiates between several types of works:
Necessary works. These relate to building safety, habitability, or structural integrity. In many cases, they do not require unanimous consent and may even be mandatory.
Improvements. Optional additions such as new leisure areas or enhanced services usually require qualified majorities.
Accessibility measures. The installation of elevators or removal of architectural barriers benefits from a specific legal regime, particularly when requested by elderly or disabled residents.
Energy efficiency projects. Solar panel installations and sustainability improvements also have defined majority thresholds under current regulations.
Before submitting any proposal to vote, it is essential to determine its legal classification and the corresponding voting requirement. Proper legal assessment prevents disputes and ensures that approved works are enforceable.
