Late payment of community fees is one of the most common financial challenges faced by homeowners associations. Even a single delinquent owner can affect the financial stability of the entire building.
To recover unpaid fees, certain formal requirements must be met. The debt must be approved in a duly recorded meeting, accurately reflected in the minutes, and formally notified to the debtor.
The first recommended step is an amicable request for payment, offering the owner an opportunity to settle the outstanding amount voluntarily. If this fails, the association may initiate legal proceedings through the expedited payment order procedure regulated by the Ley de Enjuiciamiento Civil.
This procedure allows associations to claim documented debts efficiently. If the debtor neither pays nor files an objection, enforcement proceedings may follow, including asset attachment.
Accuracy in documentation is crucial. Incorrect notices or improperly drafted minutes can delay proceedings and increase legal costs. Proper legal and administrative management significantly improves recovery rates and protects the financial interests of the community.
